Oklahoma Insurance Coverage Disputes

Disagreements over whether there is coverage under the insurance policy for damages and events is something to be expected. In Oklahoma, coverage disputes are routinely resolved by declaratory judgment actions. The courts are the appropriate solution to fairly obtain the answer to questions in which there is a disagreement with the policyholder.

Attorneys familiar with coverage disputes often use declaratory judgment to judicially determine the disputed issues. Although coverage analysis initially starts with the insuring agreement or contract, it is often altered by statutes, regulations, and case law from the Oklahoma courts and legislature. Therefore, a final adjudication by the courts addresses the policy language in addition to any applicable Oklahoma law.
